VIC Companies Facing Charges Following Skid Steer Loader Fatality

WorkSafe Victoria has brought charges against two related construction companies after a worker died from an incident at a Bangholme depot two years ago. This is the latest news involving a fatal workplace incident linked to mobile plant equipment in Victoria.

The worker was struck by a skid steer loader operated by a colleague after regular working hours and subsequently succumbed to injuries in hospital.

The incident happened in September 2022.

Charges Under the OHS Act

Each company is charged under section 21(1) of the Occupational Health and Safety Act for failing to provide a safe work environment. Under Victorian OHS law, employers carry a duty to eliminate or reduce risks associated with plant such as a steer loader wherever reasonably practicable.

The companies are facing one more charge under section 23(1) of the same Act for negligence in ensuring that people who are not employees were safeguarded against health and safety risks. This second charge highlights how OHS obligations extend beyond direct employees to anyone present at a worksite, including contractors and visitors.

The case is scheduled for a filing hearing at the Melbourne Magistrates' Court early next month.

Why Skid Steer Loader Safety Matters

Incidents involving a skid steer loader often occur during periods of reduced supervision, such as after standard shift hours, when risk controls may not be actively monitored. Employers should ensure operators follow documented procedures, including a Skid Steer SOP and a Bobcat/Skid-Steer Loader Operation SWMS, to minimise risk of collision with pedestrians or other workers.
