Two recent workplace incidents demonstrate how inadequate safety controls contribute to preventable worker harm. One case involves a maintenance worker crushed during machine operation; the other traces how heat exhaustion leads to worker death on a Queensland farm. Both cases underscore the risk employers face when safety systems fail.

Conviction and Fine After Maintenance Worker Crushed

An employee at a food manufacturer suffered a traumatic incident while undertaking maintenance work on an active machine, resulting in a $125,000 fine against the company.

The Dandenong Magistrates Court heard that in January 2019, a worker crawled under a conveyor inside a large warming chamber used to prove dough, aiming to clear a blockage. Another employee acting as a "spotter" communicated via radio with a third worker positioned at the control panel, who had no visibility inside the chamber.

The maintenance worker was crushed when the console operator started the machine, mishearing the spotter's response when asked whether he should "inch" the conveyor back and forth to free the jam. He remained trapped for 30 minutes, sustaining internal bruising, minor scarring, and lower back pain.

The company pleaded guilty in June 2019 to failing to provide a safe workplace, specifically for not supplying an auxiliary control that would eliminate or reduce risk to personnel carrying out maintenance while equipment operates. This incident echoes patterns seen in other cases, such as the worker crushed to death at a Melbourne warehouse, where communication breakdowns and inadequate isolation procedures proved fatal.

No Inquest for the Death of Belgian Backpacker on North Queensland Fruit Farm

A Belgian backpacker picking fruit at a family-run farm near Home Hill was working toward a second-year extension on his Working Holiday Visa when he died on November 1, 2017.

The 27-year-old, contracted to pick watermelons for a day in Ayr before harvesting pumpkin crops, had worked three days when colleagues noticed him exhausted and struggling to keep pace. He then became delirious, ran erratically through the field, and collapsed convulsing seven hours into his shift.

Despite efforts to cool him, he remained unresponsive, and first responders at the scene recorded a body temperature of 48°C. Northern coroner Nerida Wilson's investigation found that the man's organs failed due to heat stroke sustained while working in conditions reaching 40°C in direct sun. She ruled his death preventable, caused by a fatal combination of limited shade, extreme heat, and inadequate preparation — a clear causal factor behind this tragic case.

In 2019, the man's family wrote to the Coroner requesting an inquest before learning that both the farm owner and contractor would face charges. Investigations by the Office of Industrial Relations found that despite the extreme heat and minimal shade, workers faced pressure to continue working, and the employers' failure to properly assess the danger of these conditions significantly contributed to the backpacker's death.

A Coroners Court of Queensland spokesman confirmed the matter did not require an inquest given the finalisation of the investigation. The farm owner and contractor received fines of $100,000 and $65,000 respectively for breaching Queensland's Work Health and Safety Act.
