WorkSafe files charges against construction firm following worker's fall

A construction company has been charged by Victoria’s workplace safety watchdog after an employee sustained severe head and spinal injuries from a fall at a Melbourne worksite two years ago.

WorkSafe said the worker, aged 28, was on an A-frame ladder, trying to cut a tree branch with a chainsaw, when he fell nearly four meters to the ground.

The company is confronted with four allegations pursuant to section 21(1) of the Victorian OHS Act for not providing and maintaining, to the extent that it is 'reasonably practicable', a work environment that is safe and devoid of health risks.

The firm is facing two extra charges in accordance with section 26(1) of the OHS Act for not guaranteeing that a workplace under its supervision and control was safe and free from health risks.

The case is set for a filing hearing at Melbourne Magistrates' Court on 20 March 2026
