Mining company avoids prosecution after NSW Resources Regulator agrees to WHS undertaking proposal

The NSW Resources Regulator has approved a Work Health and Safety (WHS) enforceable undertaking from a mining company concerning a significant incident that took place in Boggabri on December 6, 2021.

In an incident that did not result in any physical harm, a haul truck narrowly avoided a collision with a light vehicle carrying two passengers. The light vehicle had halted at a T-intersection on an access road at the mine.

Following an investigation, prosecution actions were initiated against the company in the District Court on 20 September 2023 for alleged breaches of the Work Health and Safety Act 2011.

On December 5, 2024, the company presented a proposal for a WHS initiative, which has received approval from the Regulator.
