Comcare files charges against construction firm for worker fall injuries
Comcare has charged a construction company for infringing upon federal work health and safety laws after a worker sustained severe injuries as a result of a fall.
Following an investigation by the national work health and safety regulator, the Commonwealth Director of Public Prosecutions has initiated a single charge, alleging that the company failed to meet its duties as required by the Commonwealth Work Health and Safety Act 2011 (WHS Act).
During the incident on 25 August 2023, a worker fell from the top of a reservoir, descending more than six metres to the ground, and suffered multiple fractures to his ribs and spine.
The offence is classified as Category 2 under the WHS Act, with a potential maximum fine of $1.5 million.
