Charges filed against VIC fruit grower following fatal incident in cool storage room

A fruit grower is facing charges after a truckie died at a warehouse in Shepparton last year.

Authorities found a 50-year-old man unresponsive in a cool room with low oxygen levels, designed for apple storage, after someone noticed his car parked outside with the engine still running.

The company is subject to two accusations in accordance with section 26(1) of the Occupational Health and Safety Act for not guaranteeing that a workplace under its oversight was safe and free from health hazards.

WorkSafe claims the company neglected to lower the risk of significant injury or death by enforcing a ban on entry to cool rooms functioning with a controlled atmosphere and by providing clear and visible warning signage.

The case is scheduled for a filing hearing at Shepparton Magistrates' Court on Friday, December 20.
