Auckland company fined for burn injuries suffered by forklift operator

A gas explosion that caused burns to a forklift driver highlights an important lesson for workplaces, according to WorkSafe New Zealand, following a recent court verdict on the matter.
WorkSafe said the incident took place at a business in south Auckland in March 2024, when a forklift caught fire, which ignited Liquefied Petroleum Gas (LPG) that had been released from condemned cylinders.
The driver suffered burns that required hospitalisation and was away from work for nine weeks.
While delivering the sentence, Judge Gus Andrée Wiltens of the Manukau District Court characterised the danger as “clear and obvious.”
WorkSafe's lead inspector, David Worsfold, said the issue goes beyond merely flammable gases. He said it highlights a recurring pattern seen throughout different sectors.
“Businesses may identify risks but can fail to follow through with proper controls,” he said.
“They have procedures but don't ensure they're working in practice.”
